Chancery Chambers| Bankruptcy and Companies Court

The Chancery Division of the High Court is based in the Thomas More Building at the Royal Courts of Justice in London and is divided between Chancery Chambers and Bankruptcy and Companies Court.

The Office hours are 10.00am to 4.30pm

Our Work

The work of the Chancery Division, which is dealt with by Chancery Chambers, includes claims relating to:

• trusts
• contentious probate (contesting the validity of a will)
• companies
• land
• other claims - for example for professional negligence or breach of contract – which involve issues of trust, company, land or conveyancing law or procedure
• claims for dissolution of partnerships or the taking of partnership accounts
• claims under the Inheritance (Provision for Family & Dependants) Act 1975 proceedings for breach of a restrictive covenant(an agreement in a deed which limits an owner's use or enjoyment of his/her property); breach of trust or fiduciary duty (the duty owed by a person who is in a position of trust e.g. solicitor or trustee)
• commercial disputes including international commercial disputes
• claims relating to membership of or exclusion from or dissolution of a club or other incorporated association
• revenue matters (i.e. appeals against various taxes such as Income Tax or VAT)
• Patents Court: intellectual property such as copyright, patents & registered designs, trademark infringements, inventions and passing off (a person's goods or services being misrepresented as someone else's). Although listed separately, proceedings in the Patents Court are issued in Chancery Registry and dealt with by Chancery Judges and Masters nominated to do so.

Chancery Masters

The Chancery Masters are:

All applications for hearings before the Masters should be made to the Masters Appointments Section (Room TM 709). All correspondence regarding matters before the Chancery Masters should be sent to this section initially.

Registry  

Located in room TM 5.05 on the 5th floor, this section is responsible for:  

• issue and amendment of all Chancery process
• admissions
• filing of defences
• acknowledgements of service & certificates of service
• allocation questionnaires
• notices of change
• claim searches & requests for office copy documents
• lodging applications for default judgments
• dealing with queries about court fees
• issuing of witness summonses 
• filing of affidavits and witness statements (save those lodged within 2 days of a hearing before a Master, which are filed in room TM 7.09)
• transfers in to and out of Chancery Division from other courts (i.e. other divisions of the High Court or County Courts)

Masters' Appointments Section

Located in room TM 7.09 on the 7th floor, this section is responsible for:

• issuing of application notices for hearing before the Chancery Masters
• fixing hearings before the Chancery Masters
• dealing with applications for consent orders
• applications without notice before the Chancery Masters
• lodgment of skeleton arguments and bundles for hearings before the Chancery Masters
• filing of affidavits and witness statements within 2 days of hearings before the Chancery Masters
• applications to serve documents out of the jurisdiction (i.e. outside England and Wales)
• filing testamentary documents and grants under Part 57 of the Civil Procedure Rules in contested probate cases

Orders and Accounts Section (Court Associates)  

Located in room TM 5.07on the 5th floor, this section is responsible for:

• drafting of Judges' and Masters' orders
• drafting and checking of payment schedules resulting from Masters' orders
• miscellaneous payments out of court
• judicial trustee and in contested probate cases receivership work
• lodgments in court pursuant to the Trustee Act 1925
• filing of Affidavits relating to payments into court under the Trustee Act 1925, the Compulsory Purchase Act 1965 & the Lands Clauses Consolidation Act 1845.
• registering of judgments, orders & fines under the Registration of Judgments, Orders & Fines Regulations 2005

Chancery Associates
Located in room TM 507A on the 5th floor, this section is responsible for:

• Associates to the Chancery Judges
• drafting of Judges' orders and dealing with any resulting queries
• drafting and checking of payment schedules resulting from Judges' orders
